Your use of the services provided by Funjet Vacations and Fotki is subject to the following agreement. Violations of this agreement may result in termination of any submitted content with or without notice. Funjet recommends that members maintain their own backups of any 'irreplaceable' content, as Funjet cannot warrant that no loss or corruption of data shall occur.

As used herein, "content" shall mean all text, graphics, photographs, pictures, drawings, animation, audio, video, and any other material submitted, posted, viewed, transmitted, reproduced and/or distributed by any person or entity in connection with Funjet Vacations or Fotki.

Prohibited content includes but is not limited to: (1) programs containing Trojan horses, virus and/or tools to compromise the security of Funjet Vacations, Fotki and/or other sites, (2) solicitations or advertisements, (3) suggestions or encouragement of illegal activity, (4) private information about any individual such as phone numbers, addresses, Social Security numbers or any other private information, and (5) duplicative posting or "spamming" (6) posting containing offensive or inappropriate remarks.

Content can be submitted only by its owners. In the event that ownership of any content is contested in any manner, Funjet Vacations and Fotki retains the discretion to reject that content and discontinue use of the content. Submitted content may be displayed on the album pages, as well as used in materials promoting this or similar competitions by Funjet Vacations, Fotki and its affiliates. Content is submitted without any fee or other form of compensation from Funjet Vacations, Fotki or its affiliates. Posted content will be subject to Fotki Terms of Service and other policies. Content will be credited to the user named in the submission form. By submitting content, you grant Funjet Vacations the right to use such submittal for any promotional purposes whatsoever without compensation or permission. Any submittal will not be returned to you and will become the possession of Funjet Vacations. Funjet Vacations, Fotki and its affiliates reserve the right, in their sole discretion, to cancel or suspend all or any portion of a photo gallery without notice. Funjet Vacations, Fotki and its affiliates reserve the right to deny admission of any photo to the competition.

By submitting content, you agree to release and hold harmless Funjet Vacations, Fotki and its employees, officers, affiliates, agents, and advertising and promotional agencies from any and all damages, injuries, claims, causes of actions, or losses of any kind resulting from your submission, including infringement of intellectual property rights by other parties. Funjet Vacations, Fotki and its employees, officers, affiliates, agents, and advertising and promotional agencies assume no responsibility or liability for any damages, injuries, claims, causes of actions, or losses of any kind arising in whole or in part from this submission. By entering any contest on Funjet.com, all entrants agreed that Funjet Vacations has the sole right to decide all matters and disputes arising from the contest and their determination of the winner is final and binding. Winning photos will be selected at Funjet Vacations, Fotki and its affiliates™ full discretion, on the basis of creativity, photographic quality, and effectiveness in conveying the message relevant to the competition.
